AI Assistant for Real Estate Agents: What to Hand Off in the US
An AI assistant for a real estate agent answers new enquiries, asks the first qualifying questions and hands a ready lead to a person. What it can safely take off your plate, what it cannot, and the federal consent law (the TCPA) you still have to respect when it sends a text.

An AI assistant for a real estate agent answers a new enquiry the moment it arrives, asks the first few qualifying questions and hands a person a ready lead. It does not replace the agent. It covers the hours and the volume an agent cannot, and it leaves every decision about price, terms and advice to a human.
This post covers what is safe to hand off, what is not, and the one federal law that every US agent should know before an assistant sends a text.
What can an AI assistant handle for an agent?
The repetitive first stage of a lead.
| Task | Hand it off? | Why |
|---|---|---|
| Reply to a new enquiry at night or on a weekend | Yes | The slow reply is the problem it solves |
| Answer questions from listing details you supplied | Yes | It should only answer from that material |
| Ask budget, timeline and area | Yes | Short, structured, and saved on the lead |
| Book a showing request for you to confirm | Yes | A person confirms it |
| Quote a price, negotiate or promise terms | No | That is your decision |
| Give mortgage, legal or tax advice | No | It needs a licensed professional |
The questions a real estate chatbot should ask covers the qualifying step in more detail, and the real estate chatbot guide covers the whole setup.
What does the TCPA say about texting a lead?
The Telephone Consumer Protection Act, 47 U.S.C. § 227, restricts certain calls to cell phones. As the statute is worded, calls made using an automatic telephone dialing system or an artificial or prerecorded voice are covered unless they are made "with the prior express consent of the called party."
The penalty is not small. A person who receives a violating call can sue for their actual loss or $500 in damages for each violation, whichever is greater, and a court may increase the award up to three times for a willful or knowing violation.
This post does not say whether a particular text from a particular assistant is covered, or what counts as valid consent. Those questions turn on the FCC's rules and court decisions, which this post did not review. Put them to a lawyer before you automate outreach.
What is the safest way to set up follow-up?
Start from consent and work backward.
- Record where consent came from. Keep the form, the chat or the ad that the person used, with the date.
- Reply to people who contacted you first. An enquiry the person started is a different situation from a cold message.
- Make stopping easy. Honor a request to stop immediately and note it on the record.
- Keep a human on the sensitive turns. Hand off anything about price, terms or advice.
Where does Vyostra AI fit?
Vyostra AI captures leads from a chat agent and lead forms on your own website and from Meta lead ads, keeps them in one list with four statuses, and follows up on WhatsApp. It does not import enquiries from Zillow, Realtor.com or other portals, and it does not manage listings or deals. If your leads mostly come from portals, you need a brokerage CRM as well. See what a WhatsApp CRM is for how the follow-up side works.
Common questions
- What can an AI assistant do for a real estate agent?
- It can reply to a new enquiry at any hour, answer questions about listings you have given it, ask a few qualifying questions such as budget and timeline, and pass the conversation to you with the answers attached. It should not negotiate, quote a price you have not approved, or give legal or mortgage advice.
- Does the TCPA apply to a text sent by an AI assistant?
- It can. The Telephone Consumer Protection Act, 47 U.S.C. § 227, restricts calls to a cell phone that use an automatic telephone dialing system or an artificial or prerecorded voice unless the call is made with the prior express consent of the called party. A private person can sue for actual loss or $500 per violation, whichever is greater, and a court may increase that for a willful or knowing violation. Whether a particular text falls under the statute is a legal question to put to a lawyer.
- Does Vyostra AI pull leads from Zillow or Realtor.com?
- No. Vyostra AI captures leads from a chat agent and lead forms on your own website and from Meta lead ads, keeps them in one list and follows up on WhatsApp. It does not import enquiries from Zillow, Realtor.com or other portals.
